Victory In The Second Circuit On Behalf Of The New York Healthcare Workers Fighting NY’s Vaccine Mandate.

I have good news and bad news to announce today. I’ll start with the good news. The Second Circuit has granted, in part, my motion for an injunction pending appeal staying the enforcement of New York’s COVID-19 vaccination mandate against healthcare workers who have religious exemptions. A full copy of the order is below.

The bad news is that, as I stated at oral argument on Wednesday and prior to the Second Circuit issuing its order, Northwell Health has terminated my client, Diane Bono, and told her in the termination meeting that New York’s mandate compelled its actions. Ms. Bono and I have the following to say about her denial:

“Today, Diane Bono chose her faith over her job, and Governor Hochul got what she has connived to get all along: the discriminatory termination of a dedicated nurse who has faithfully served her community for 39 years. The First Amendment and Title VII prohibit this travesty, and we will continue to fight to vindicate Ms. Bono’s rights.”

My clients – We The Patriots USA, Inc., Michelle Melendez, and Michelle Synakowski – are delighted with the Second Circuit’s ruling, and we look forward to prevailing on October 14, 2021 when we will return to the Second Circuit to present oral argument for a more lengthy injunction.

Is there a new date since the case was postponed on 10/14? I’ve searched and it is impossible to find.

Hello, I am a physician employed by HHC in NYC. I have been suspended without pay for refusing to comply with the vaccine mandate. I filed for a religious exemption before 9/27, which was rejected. Does this mean they must reinstate me until 10/14, or does this only apply to people whose religious exemptions were accepted by their employer? Any advice you could give me would be greatly appreciated. Thank you!
